THCFF 2023-2024 TROUT LEASE

MEMBER & GUEST RELEASE OF LIABILITY 
ACKNOWLEDGMENT AND ACCEPTANCE OF RISKS, HAZARDS AND DANGERS

            I hereby ACKNOWLEDGE THAT The Texas Hill Country Fly Fishers Club and Scott Haas, owner at Crabapple Creek Gillespie County Texas, and the owners and staff of Tecaboca Camp Mountain Home Texas have entered a certain Lease agreement to allow access to limited portions of Crabapple Creek and Johnson Creek for fly fishing.  

            I understand, as a member of the THCFF Lease Access Program, having paid my lease access and membership fees, that I completely accept and will fully honor the rules of the lease access agreement.

            I further understand that there are natural and unnatural risks in accessing Crabapple Creek and Tecaboca (Johnson Creek) premises. I know my person, property, and any guests I bring are exposed to the same risks.  I EXPRESSLY ASSUME ANY AND ALL SUCH RISKS, HAZARDS, AND DANGERS AS MY PERSONAL LIABILITY. 

            IN CONSIDERATION FOR THE RIGHT FOR ME TO ENTER THE PREMISES covered by the above-referred to Lease,

I DO RELEASE AND AGREE TO PROTECT, INDEMNIFY AND HOLD HARMLESS, the Lessor in said Lease and Lessor's agents, employees and assigns, and the Texas Hill Country Fly Fishers Club, its directors, and officers and assigns:

 FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION OF ANY SORT AND DAMAGES, INCLUDING ATTORNEY'S FEES, RESULTING FROM ANY ACCIDENT, INCIDENT OR OCCURRENCE ARISING OUT OF, INCIDENTAL TO OR IN ANYWISE RESULTING FROM MY USE OF THE LAND AND ALL IMPROVEMENTS SITUATED THEREON, DURING THE PERIOD I AM PERMITTED ON THE PREMISES AND UNTIL I LEAVE THE PREMISES, REGARDLESS OF whether same may result from Lessor's NEGLIGENCE OR GROSS NEGLIGENCE. 

            I further covenant and agree for myself, my heirs, successors, and assigns that I WILL NOT MAKE ANY CLAIM OR INSTITUTE ANY SUIT OR ACTION AT LAW OR IN EQUITY AGAINST LESSOR, OR THEIR RESPECTIVE HEIRS, AGENTS, REPRESENTATIVES, EMPLOYEES, SUCCESSORS OR ASSIGNS AND THE TEXAS HILL COUNTRY FLY FISHERS CLUB OR ITS DIRECTORS AND OFFICERS.

            FINALLY, in consideration of the right to enter said premises for fly fishing, I understand and agree that I will not litter such premises nor harm, destroy, or damage any property or vegetation on said premises.  I accept that I will be liable for and will indemnify Lessor and Lessor's agents, employees, and assigns from and against all damages, losses, liabilities, costs, and expenses caused by my guests or me as a result of my (our) acts, conduct, omissions or failures, including without limitation any damage to any premises ranch or camp property, and vegetation.
