THCFF 2025-2026 TROUT LEASE MEMBER
ACKNOWLEDGMENT AND ACCEPTANCE OF RISKS, HAZARDS AND DANGERS
I hereby ACKNOWLEDGE THAT The Texas Hill Country Fly Fishers Club, Scott Haas, owner at “Crabapple Creek Lease”, entered into a Lease agreement allowing access to limited portions of Crabapple Creek for fly fishing during 2025 and 2026. Also, as a member of the THCFF Lease Access Program, having paid my lease access and membership fees, I accept and will abide by all of the rules of the lease member’s property access agreement.
I further understand that there are inherent physical risks in accessing all premises at Crabapple Creek. I EXPRESSLY ASSUME ALL SUCH RISKS, HAZARDS AND DANGERS with the understanding that I am exposing both my person and property to the same hazards and dangers that exist anytime accessing the property known as Crabapple Creek Lease.
IN CONSIDERATION FOR THE RIGHT FOR ME TO ENTER THE PREMISES covered by the above-referred-to Lease, I DO HEREBY RELEASE AND AGREE TO PROTECT, INDEMNIFY, HOLD HARMLESS, Lessor in said Lease and Lessor's agents, employees and assigns, and the Texas Hill Country Fly Fishers Club, its directors and officers:
FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION OF ANY SORT AND DAMAGES, INCLUDING ATTORNEY'S FEES, RESULTING FROM ANY ACCIDENT, INCIDENT OR OCCURRENCE ARISING OUT OF, INCIDENTAL TO OR IN ANYWISE RESULTING FROM MY USE OF THE LAND AND ALL IMPROVEMENTS SITUATED THEREON, DURING THE PERIOD OF TIME I AM PERMITTED ON THE PREMISES AND UNTIL I LEAVE THE PREMISES, REGARDLESS OF whether same may result from Lessor's NEGLIGENCE OR GROSS NEGLIGENCE.
I hereby further covenant and agree for myself, my heirs, successors, and assigns, that I WILL NOT MAKE ANY CLAIM OR INSTITUTE ANY SUIT OR ACTION AT LAW OR IN EQUITY AGAINST LESSOR, OR THEIR RESPECTIVE HEIRS, AGENTS, REPRESENTATIVES, EMPLOYEES, SUCCESSORS, OR ASSIGNS, AND THE TEXAS HILL COUNTRY FLY FISHERS CLUB, ITS DIRECTORS AND OFFICERS.
FURTHER, in consideration for the right to enter said Premises I understand and agree that I will not litter such Premises nor burn, harm, destroy or damage any property or native plant on said Premises, and I will be liable for and will indemnify Lessor and Lessor's agents, employees and assigns, from and against, all damages, losses, liabilities, costs and expenses caused by me or as a result of my acts, conduct, omissions or failures, including without limitation any and all damage to any ranch or camp property.
